OUR GENERAL TERMS & CONDITIONS
1. DEFINITIONS
- “Supplier” shall mean Sydney Electrical and Building Services Pty Limited its successors and assigns or any person acting on behalf of and with the authority of the Supplier.
- “Customer” shall mean you or any person acting on behalf of and with the authority of the Customer.
- “Goods” shall mean Goods supplied by the Supplier to the Customer, and where the context so permits shall include any supply of Services as defined, and are as described in Tax invoices, statements or any other forms as provided by the Supplier to the Customer.
- “Services” shall mean all Services supplied by the Supplier to the Customer and includes any advice or recommendations, and where the context so permits shall include any supply of Goods as defined above.
- “Price” shall mean the price payable for the Goods as agreed between the Supplier and the Customer in accordance with clause 3 of these terms.
2. ACCEPTANCE
- Any instructions received by the Supplier from the Customer for the supply of Goods and/or the Customer’s acceptance of Goods supplied by the Supplier shall constitute acceptance of the terms and conditions contained herein.
- Where more than one Customer has entered into this agreement, the Customers shall be jointly and severally liable for all payments of the Price.
- Upon acceptance of these terms and conditions by the Customer the terms and conditions are binding and can only be amended with the written consent of the Supplier.
- The Customer undertakes to give the Supplier at least fourteen (14) days or as soon as practicable, notice of any change in the Customer’s details
3. PRICE AND PAYMENT
- At the Supplier’s sole discretion, the Price shall be as indicated on invoices provided by the Supplier to the Customer in respect of Goods supplied.
- The Supplier reserves the right to change the Price in the event of a variation to the Supplier’s quotation. The Supplier’s pricing is live on the website and prices can increase or decrease at any time. In result of a supplier increasing a product price it reflects the Suppliers new sell price. The Supplier reserves the right not to honour existing prices before the increase.
- Payment is to be made by terms and conditions of existing account holders with the Supplier, by credit card (plus a surcharge of up to 2% of the Price), by direct deposit or electronic funds transfer.Orders paid by Direct Deposit or Electronic Funds Transfer will not be processed until payment has been received. Please ensure that you include the order/invoice number in the transaction reference.
- Orders placed on a weekend or a public holiday will process on the next business day. We will email a tax invoice to you once we have processed your order and payment. Your tax invoice is your proof of purchase.
- Any taxes and duties that may be applicable and GST shall be added to the Price as well, except when they are already included in the Price.
4. SHIPPING AND DELIVERY
- At the Supplier’s sole discretion delivery of the Goods shall take place when:
- the Customer takes possession of the Goods at the Suppliers address; or
- the Customer takes possession of the Goods at the Customers nominated address; or
- the Customers nominated carrier takes possession of the Goods in which event the carrier shall be deemed to be the Customer’s agent.
- At the Suppliers sole discretion the costs of delivery are:
- in addition to the Price;
- free delivery (for qualified Customer); or
- By Customer’s own courier.
- The Customer shall make all arrangements necessary to take delivery of the Goods whenever they are tendered for delivery. If the Customer is fail to take delivery of the Goods as arranged, then the Supplier shall be entitled to charge a reasonable fee for redelivery.
- Delivery of Goods to a third party nominated by the Customer is deemed to be delivery to the Customer for the purposes of this agreement.
- The failure of the Supplier to deliver shall not entitle either party to treat this contract as repudiated.
- The Supplier shall not be liable for any loss or damage whatever due to failure by the Supplier to deliver the Goods (or any of them) promptly or at all.
- If for any reason that your order becomes unavailable, we will let you know and sometime offer an alternative.
5. DEFECTS
- The Customer shall inspect the Goods on delivery and shall within seven (7) days of delivery or as soon as practicable, notify the Supplier of any alleged defect, damage, failure to comply with the product description, quote or shortage in quantity. The Customer shall allow the Supplier an opportunity to inspect the Goods within a reasonable time following delivery if the Customer believes the Goods are defective in any way. If the Customer shall fail to comply with these provisions the Goods shall be deemed to be free from defect or damage.
- Where Goods are claimed to be defective the Supplier reserves the right to forward those Goods to their suppliers for assessment and approval of any claim.
- For defective Goods, which the Supplier has agreed in writing that the Customer is entitled to reject, the Suppliers liability is limited to either (at the Suppliers discretion) replacing the Goods or repairing the Goods. The Supplier shall not be liable for any other costs howsoever arising out of the inadvertent supply of defective Goods.
6. EXCHANGE
- The Supplier will only do Exchange provided that:

- the Customer has complied with the provisions of clause 5; and
- the Goods are exchanged at the Customers cost within sevem (7) days of the delivery date; and
- the Supplier will not be liable for Goods which have not been installed by a qualified tradesman, or misuse; and
- the Goods are exchanged in the perfect condition in which they were delivered and with all packaging material in an unused condition.
- The Supplier may (in its discretion) accept the exchange of Goods for our store credit.
7. WARRANTY
- To the extent permitted by statute, no warranty is given by the Supplier as to the quality or suitability of the goods for any purpose and any implied warranty, is expressly excluded. The Supplier shall not be responsible for any loss or damage to the Goods, or caused by the Goods, or any part thereof however arising.
8. LIABILITY
- Whilst we make every effort to ensure the information contained within our website is complete, accurate and current, we do not guarantee this, and assume no responsibility for any errors of any kind in the content of the website.

- The supplier shall not be held responsible for injuries or deaths incurred whilst installing any products pruchased from us.
